When a bank fails, account holders must answer two separate questions: which part of the balance is covered by deposit protection and which amount remains an open claim against the bank? In Austria, the general protection limit is 100,000 euros per depositor and credit institution. Covered deposits held with the same institution are added together.

The account label alone does not decide the result. The relevant points are the account holder, the type of balance, the allocation on joint or trust accounts and the identity of the credit institution. An amount above the protection limit does not disappear. It has to be classified as a remaining claim against the bank after the guarantee event.

This article sets out the review path for account balances after a bank failure. It focuses on the protection limit, aggregation, evidence and the distinction between deposit reimbursement and a later claim in the bank insolvency proceedings.

Review bank balances

How should your balance be classified after a bank failure?

This short check considers the account holder, the credit institution and the evidence. It does not replace a review of the specific guarantee event.

Discuss the specific matter with the firm.

01 Question 1

Are you clearly identified as the account holder or entitled person?

Secure account-opening records, statements and the identification details of all beneficiaries.

Your answers

Review the documents

01

Calculate the protected amount and remaining claim separately

Assign each account to the legal credit institution and add the covered deposits. Set the amount above the protection limit, interest and any open bank claims out separately from the protected amount.

02

Prove the account holders and beneficiaries first

For a joint or disclosed trust account, the entitled persons and their shares must be traceable. Present the account agreement, the arrangement, identification records and the agreed allocation together.

03

Clarify the credit institution and guarantee scheme

Compare the statement, account documents, the bank information and the deposit guarantee notice. Only the legal identity of the institution shows which balances belong together for the 100,000-euro limit.

Identify the guarantee event and covered deposit

Deposit protection requires a guarantee event at a credit institution. The first step is therefore to record which bank holds the account and which notice establishes the failure. Austrian deposit protection generally covers balances in accounts and savings products where they qualify as eligible deposits.

The general limit is 100,000 euros per depositor and credit institution. It applies to the depositor, not to each individual account. Deposits with separate legal credit institutions are assessed separately. Where a bank uses several brands, its legal entity must be checked.

Temporary high balances may reach 500,000 euros in cases defined by law. The special conditions, the relevant period and written evidence must be checked. The exception cannot be applied to every large balance as a matter of course.

Separate the positions

Keep the protected deposit and remaining claim distinct

One balance may raise several questions. Each position needs its own calculation and evidence trail.

Review fields after a bank failure
Review position Question Useful evidence
Deposit protection Reimbursement up to the protection limit Which eligible deposits belong to one depositor at this institution? Statements, savings record, account agreement, bank notice and IBAN
Aggregation All accounts with the same institution Were current, savings and fixed-term accounts and brands assigned correctly? Legal bank name, agreements and account overview
Remaining claim Amount above the reimbursement Which part remains open as a claim against the bank? Balance at the guarantee event, reimbursement statement and bank records

This table is a working structure. Whether and to what extent a remaining claim exists depends on the balance, reimbursement and the specific bank proceedings.

Add all balances held with the same credit institution

The protection limit is calculated from one depositor’s eligible deposits with the same credit institution. Accounts with different product names remain part of that calculation. A current account, an instant-access account and a savings book therefore do not automatically receive separate protection of 100,000 euros each.

The bank must be identified by its legal name. A brand, trading name or Austrian branch does not by itself show which guarantee scheme covers the balance. Check the account documents and the bank information on deposit protection.

The calculation starts with the balance on the day of the guarantee event. Accrued deposit interest is treated under the statutory rules. Foreign-currency balances are converted into euros for reimbursement. Keep the guarantee scheme’s calculation and payment statement.

Review joint and disclosed trust accounts

For a joint account, the limit generally applies to each identified depositor. Unless a valid different allocation has been provided to the bank, the balance is generally allocated equally among the account holders for the calculation. The account documents must show the number and identity of the holders.

For a disclosed trust account, the beneficiaries may be treated as depositors. The allocation to the entitled person must be traceable under the statutory rules. Calling an account a trust account does not replace disclosure and proof of the beneficiaries.

Organise the account agreement, powers of attorney, trust arrangement, allocation rule and identification records. If the information is missing or inconsistent, payment may be delayed while the guarantee scheme clarifies entitlement.

Classify the amount above 100,000 euros as a remaining claim

Deposit protection pays the covered part of the balance. The amount above the general limit therefore does not become an insured deposit. It remains a claim against the bank and must be assessed in the bank proceedings according to its rank and enforceability.

Calculate the open amount finally after the reimbursement statement is available. Take the balance at the guarantee event, reimbursed sums, permitted set-offs and accrued interest into account. An initial notice from the bank may be supplemented by the final statement.

Keep the guarantee payment and the claim against the bank on separate calculation sheets. This makes clear which amount has already been reimbursed and which amount must still be pursued in the bank insolvency. Filing an ordinary insolvency claim is a separate procedural step.

Organise evidence for reimbursement and the remaining claim

Secure statements, savings records, account-opening documents, bank notices and correspondence with the guarantee scheme. For companies, accounting records and the internal allocation of the balance should also be retained. The key evidence connects the depositor, institution, balance and reimbursement.

A temporary high balance requires additional proof of its origin and of the relevant life event or property transaction. A high account balance alone does not establish the exception.

After payment, prepare a reconciliation showing the opening balance, protected amount, any special amount, payment and remaining claim. Record inconsistencies between statements, the bank notice and the payment and resolve them against the underlying documents.

Important: The 100,000-euro limit generally applies per depositor and credit institution. Several accounts with the same bank are added together. The uncovered part remains a separate claim against the bank.
FAQ

Questions about balances after a bank failure

Are 100,000 euros protected on every account? +

The limit generally applies per depositor and credit institution. Eligible balances across several accounts with the same bank are added together.

What happens to the amount above 100,000 euros? +

The excess is generally outside ordinary deposit protection. It remains a claim against the bank and must be assessed separately in the bank proceedings.

Does the limit apply to each person on a joint account? +

Generally yes, if the account holders are identified. The balance is allocated under the statutory rules and any valid allocation rule provided to the bank.

Can a higher balance receive temporary protection? +

Certain balances defined by law may receive temporary protection up to 500,000 euros. Their origin, timing and evidence must be reviewed in the individual case.
